The Commercial Real Estate, Banking and Land Use Section at Young Conaway provides a full range of services required for commercial real estate acquisition, development, financing and disposition for projects in and around Delaware, as well as the surrounding region, including Pennsylvania, Maryland and New Jersey.

As members of this section, Young Conaway attorneys represent major developers and lenders for interstate and intrastate projects, involving acquisition, land use, leasing, zoning, planning, construction and permanent mortgage financing. Projects include:

  • office and apartment buildings,
  • warehouses,
  • condominiums,
  • shopping centers,
  • communications towers,
  • residential developments, and
  • other specialized areas within the real estate field.

The section includes the firm's banking law practice and ongoing representation to national, regional and local banking institutions for the negotiation and review of loan documentation and procedures, providing advice concerning Delaware banking regulatory matters. The banking law practice also assists in the counseling of real estate and commercial clients with respect to banking relationships. 


Using innovation, creativity and cutting-edge aggressive approaches, our attorneys contribute to the success of our clients' ventures, whether it is seeing a project through from start to finish, or being asked to assist in a particular aspect of a transaction. Members of our team are approved to serve as closing and policy writing agents for major title insurance companies locally and nationally. Our experience in the commercial real estate market provides the necessary familiarity with local and regional issues such as zoning and environmental requirements.

Young Conaway attorneys regularly represent clients in purchases and sales by real estate investment trusts, entity conduits and limited liability entities. Our practice represents landlords and tenants with respect to the leasing of apartments, office and commercial space, and retail shopping centers. Few large scale real estate projects in the state do not include Young Conaway's participation at some level.

The section works closely with other firm practices to either provide their clients with real estate counsel or offer our clients with assistance in many of the related interdisciplinary practice areas such as tax, bankruptcy, employment law, intellectual property, commercial transactions and corporate litigation.

Real Estate attorneys serve as Delaware counsel to regional and national clients that conduct business in the state, as well as special Delaware counsel for transactions involving business operations and real estate projects throughout the United States that utilize the state's corporations, limited partnerships or related entities.

Members of the practice are active in state organizations such as the Committee of 100, Homebuilders Association of Delaware, Delaware Contractors Association, Delaware State Chamber of Commerce, and the Delaware State Bar Association, as well as national organizations, including the American Bar Association's Real Estate Section.
