The Environmental Law Section at Young Conaway represents clients in public and private litigation and in administrative agency proceedings, and counsels businesses and individuals on regulatory compliance matters.

The Environmental Law Section at Young Conaway represents clients in public and private litigation and in administrative agency proceedings, and counsels businesses and individuals on regulatory compliance matters. Because environmental issues routinely arise in commercial transactions, real estate, bankruptcy and other significant areas of practice within the firm, we frequently provide the firm's business clients with answers and assistance.

We defend enforcement actions brought by state and federal regulatory agencies, often involving solid and hazardous waste disposal, underground storage tanks and pollutant discharges. These matters involve practice before agency hearing officers and administrative boards, as well as the defense of cost-recovery and civil penalty actions filed in court by public agencies. Young Conaway also defends site owners and waste generators in EPA and state Superfund matters.

The Section handles private party litigation over environmental losses and liabilities, pursuing cost-recover actions on behalf of clients. We also defend toxic tort actions and asbestos-related lawsuits in Delaware's Superior Court.

Young Conaway represents insurance companies in litigation concerning coverage for environmental and toxic tort losses. We also routinely advise insurance companies on the handling of such claims outside of litigation.

Our attorneys are active in the Environmental Law Section of the Delaware State Bar Association and on the Environmental Committee of the Delaware State Chamber of Commerce. We frequently participate as moderators and panelists at seminars for attorneys and businesses in the industry. In consultation with the Delaware Department of Natural Resources & Environmental Control, the firm assisted the Delaware Contractors Association in publishing a regulatory compliance manual for contractors
