Workers' Compensation Defense

The Employment Law Section now includes a team dedicated to defending employers in workers compensation claims.  Workers compensation insurance and the cost of defending employee claims for work-related injuries represent an ever increasing expense for employers.  Such claims may also involve the complex interplay with the Family and Medical Leave Act (FMLA) and the Americans with Disabilities Act (ADA).

Our workers compensation defense team is dedicated to defending employers against such claims.  The Section also counsels and defends employers facing workers compensation claims on FMLA, ADA, and related issues.

Our workers compensation defense team has a three decade relationship with the Delaware Industrial Accident Board (IAB) and have handled appeals in Delaware’s Superior and Supreme Court.  The team offers creative solutions for disputed claims that allow for cost-effective outcomes.  Areas of interest include: stress claims, occupational disease and “sick building” cases, defense disability and permanent injury claims. and management of medical treatment issues.  Our attorneys have been consistently selected for inclusion in The Best Lawyers of America® and as Delaware Today’s “Top Lawyers”.

The Section also publishes Delaware Detour & Frolic, Young Conaway’s Workers’ Compensation blog, providing informative posts to employers. Detour & Frolic has been named a LexisNexis Top 25 blog for workers’ compensation and workplace issues since 2009.  Young Conaway also maintains the only collection of unreported IAB decisions going back to 1985 and is the home of the Randy J. Holland Workers’ Compensation Inn of Court.
