Assessing Patent Protections Afforded Under the Safe Harbor, American Conference Institute’s 2nd Annual Passport to Proficiency on the Essentials of Hatch-Waxman and BPCIA

Samantha G. Wilson of Young Conaway's Intellectual Property Litigation team will be speaking at the American Conference Institute’s 2nd Annual Passport to Proficiency on the Essentials of Hatch-Waxman and BPCIA.  The Passport to Proficiency program provides attendees with the opportunity to immerse themselves in a weekly class for four weeks and emerge proficient in their understanding of industry trends in this area of law.

Ms. Wilson will be co-presenting with Emily R. Whelan, Partner, Wilmer Cutler Pickering Hale and Dorr LLP in the session entitled "Assessing Patent Protections Afforded Under the Safe Harbor."  During this session, the co-presenters will discuss the Brand and Generic points of view on a variety of topics related to the safe harbor of the Hatch-Waxman Act 35 USC § 271(e)(1) including:

  • Understanding the safe harbor’s scope of protection for otherwise infringing activities
  • Examining the safe harbor protections afforded to research tool patents
  • Identifying safe harbor protections relative to:
    • basic R&D
    • new product screening
    • optimization
    • pre-clinical testing
    • post-approval testing
