Equal Opportunity Employment Commission (EEOC) v. BE&K Engineering Company

On March 5, 2008, the federal District Court for the District of Delaware granted summary judgment to the employee-defendant, BE&K Engineering Company, in an age discrimination case brought by the Equal Employment Opportunity Commission (EEOC).

The Court ruled that the EEOC failed to satisfy its prima facie burden, finding no evidence that BE&K had laid-off a chemical engineer because of his age.
