McCormick and Rohrer file Amicus Brief

Young Conaway attorneys, Kathaleen McCormick and Nicholas J. Rohrer, recently filed an amicus brief  on behalf of Atlantic Center for Capital Representation as Delaware’s Supreme Court considers arguments over the constitutionality of Delaware’s capital punishment statute.  Only three states, including Delaware, permit judges to discount a jury’s recommendation for life in prison and sentence a prisoner to death.  Although Delaware judges have never reversed a jury’s finding and sentenced a prisoner to death, the ACLU and Atlantic Center for Capital Representation argue that the Delaware statute is unconstitutional and invalid.
