"Preparing for Health Care Reform With Limited Guidance," Employment Law Breakfast Seminar

The Patient Protection and Affordable Care Act, as amended by the Health Care and Education Reconciliation Act of 2010, is the result of an unusual and contentious legislative process that has produced a vague and sometimes conflicting law. The main objective of the new legislation is to provide health care for most U.S. residents, but the impact extends beyond the individual. Both small and large employers will be subject to new regulations regarding the provision of health care coverage to employees, as well as new tax and reporting requirements related to employee health coverage. However, the Act also offers incentives to employers to help reduce the cost of providing the benefits.

The changes prescribed by the new legislation will be phased in over the next several years. However, certain changes become effective immediately, and employers will be required to comply with these changes. At this point, guidance has been issued for only a few of the provisions of the Act, including:

● Age 27 dependency rules under the Internal Revenue Code;

● Age 26 coverage rules;

● Credits for health care provided by small employers;

● Subsidies for retiree coverage.

This seminar will cover the major changes for small and large employers, as well as an up-to-date summary of the guidance issued on the provisions affecting employers.
